1. Agreement

These terms govern use of Apartments For Sale NYC at apartmentsforsalenyc.com. Using the site means accepting them. If you do not accept them, do not use the site.

2. What this service is

Apartments For Sale NYC is an independent publication that compiles and republishes records published by the City of New York about buildings in the five boroughs. It is a reference work. It is not a marketplace, a listings service, a transaction platform or a professional service.

3. Not a broker, not an appraiser

This section is the important one.

• Apartments For Sale NYC is not a licensed real estate broker or salesperson in New York or anywhere else. It does not list property, does not negotiate, does not show property and does not represent any buyer or seller.
• It receives no commission, referral fee, finder's fee or any other payment tied to a transaction. Its only revenue is disclosed flat-fee advertising, set out in full on the disclosures page.
• It is not a licensed appraiser and publishes no appraisal, valuation, opinion of value, price estimate or automated valuation of any property.
• It is not a title company or abstractor. Nothing here is a title search, a title report, or evidence of the state of title, and nothing here should be relied on in place of one.
• Where a brokerage, lender or other business appears on this site it has paid a flat fee and is labelled as advertising. That is not a recommendation, an endorsement or a statement about the quality of its work.

4. No advice of any kind

Nothing on this site is legal, tax, financial, investment or real estate advice. It is information about what public files contain. Decisions about buying, selling, financing or occupying property should be taken with your own lawyer, accountant, licensed broker, surveyor and lender.

5. Accuracy and completeness

The underlying records are created by City agencies from documents filed by other people. They contain typing errors, omissions, stale values and inconsistencies, all of which are reproduced here as filed. This site adds its own risks on top: joins between files can be wrong, and a refresh can lag the agencies. The methodology page states the known limits and the corrections page logs errors found. No figure here is warranted to be correct, current or complete.

6. Prohibited uses

You may not:

• use this site or its material to harass, intimidate, stalk or target any person or household;
• present any part of it as a title report, an appraisal, a broker price opinion or a professional valuation;
• scrape, mirror or bulk-copy the compilation for a competing product, or resell it as your own dataset;
• impose an automated load that interferes with the service for other readers;
• use it for any purpose prohibited by section 7;
• remove, obscure or alter any attribution, disclosure or labelling, including the labelling of advertising.

7. No screening use

This site is not a consumer reporting agency and its material is not a consumer report. It may not be used, in whole or in part, as a factor in deciding a person's eligibility for credit, insurance, employment, housing or tenancy, or for any other purpose covered by the Fair Credit Reporting Act or an equivalent state statute. Since this site publishes no information about individuals, any such use would in any case be misuse of building records.

8. The data and this compilation

The underlying records are published by the City of New York on the NYC Open Data portal and remain subject to that portal's terms. The selection, joining, structure, written material and presentation on this site are the publisher's work. You may quote and link to individual pages with attribution. You may not republish the compilation as a whole.

9. Advertising, sponsorship and third parties

Paid placements are labelled. This site does not vet advertisers or sponsors, makes no representation about them, and is not a party to anything you agree with one. Links to external sites are provided for reference and imply no endorsement, and where a link is commercial it is disclosed as such. The rules that govern every commercial arrangement here, including the prohibition on any payment that varies with a transaction, are on the disclosures page, and section 3 of these terms is not weakened by anything in this one.

10. No warranty

The site is provided as is and as available, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. No warranty is given that the site will be uninterrupted, that defects will be corrected, or that any figure is accurate.

11. Limitation of liability

To the fullest extent the law allows, the publisher is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, of opportunity or of data, arising from use of this site or reliance on anything published on it. Total liability for any claim relating to the site is limited to one hundred United States dollars.

12. Indemnity

You agree to indemnify the publisher against claims and costs arising from your use of the site in breach of these terms.

13. Changes to the terms and to the service

These terms may change. The review date at the top of this page shows when they last did, and continuing to use the site after that date means accepting the terms as they then stand. Material changes to the commercial arrangements are also logged on the corrections page.

The publisher may change, suspend, limit or discontinue the site or any part of it at any time, with or without notice, and may add features and commercial arrangements to it, including advertising, sponsorship, affiliate arrangements, newsletters and other email to people who asked for it, paid features, and services offered on terms of their own. Nothing added this way overrides section 3: no arrangement may make this site a broker, an intermediary in a transaction, or the recipient of any payment that varies with whether or at what price a property changes hands.

14. Governing law

These terms are governed by the law of the State of New York, without regard to its conflict of laws rules, and the courts sitting in New York County have exclusive jurisdiction.
